These general conditions of sale are concluded between:

on the one hand, the company PANACEA SAS, registered with the Agen RCS under number 984 770 123 and whose head office is located at 363 Route des Aillots 47140 Penne d'Agenais, France, operating the website , hereinafter referred to as “Seller”,

and on the other hand, any natural or legal person making a purchase on the website, hereinafter referred to as “Buyer”

1. Object

Any order validated by the Buyer implies irrevocable acceptance of these general conditions of sale. These general conditions of sale may be modified at any time. The applicable conditions are those displayed on the website at the time of validation of the order by the Buyer.

2. Products

The products offered for sale by the Seller are those presented on the site on the day the Buyer consults the site. The Seller's products may be standard or personalized according to the customization criteria selected by the Buyer.

The Seller undertakes to present the best possible description and illustration for its products in accordance with article L 111-1 of the Consumer Code.

The Seller reserves the right to modify the assortment of products, their delivery times and their prices.

3. Price

Prices are presented in Euros All Taxes Included (TTC) including French VAT in force on the day of the order and excluding delivery costs. Delivery costs remain the responsibility of the Buyer unless special conditions are displayed on the Seller's website at the time the order is registered.

Prices are guaranteed subject to typographical, printing or computer malfunction.

The products are invoiced on the basis of the Seller's prices in effect at the time the order is registered on the site.

4. Order process

The Buyer who wishes to order one or more products on the Seller's website must:

6. Delivery

The Buyer's order is prepared (personalized or tailor-made products) or delivered (standard products available in stock) only after receipt of full payment by the Seller and in the absence of any dispute relating to a previous order placed by this same Buyer.

The delivery address is indicated to the Seller by the Buyer at the time of his order on the website.

Any possible customs duties and taxes linked to the delivery of products ordered on the Seller's site to another country outside mainland France are the full responsibility of the Buyer and are their sole responsibility.

In the event that one of the products ordered by the Buyer is not available after receipt of the order by the Seller, the latter undertakes to contact the Buyer by email within 2 working days at from the date of his order in order to offer him a new delivery time, a replacement item or the reimbursement of the sums paid by the Buyer for the product concerned.

7. Transfer of risks and insurance during transport

The Seller insures the value of the products which are delivered to the Buyer by the Seller's carrier. The transfer of risks occurs upon receipt of the products by the Buyer or his representative. The Buyer undertakes to check the physical condition and contents of the packages upon delivery himself or through the person of his choice who will receive the products, in the presence of the carrier making the delivery.

Any reservation on the condition of packages such as “parcel(s) received in poor condition” or “X missing package(s)” must be made at the time of receipt of the packages in the presence of the carrier. If problems are noted and confirmed upon receipt of their order after opening the packages, the Buyer undertakes to contact the Seller's Customer Service within 5 working days by email or by post and send him the photos showing the condition of the packages and the labels with the numbers of the clearly legible carrier slips as well as the copy of the documents which prove the reservations made to the carrier, in order to allow the Seller to take advantage of the insurance transportation.

8. Conformity of delivered products

In the event of non-compliance of the delivered product with the ordered product, the Buyer always has the option of returning the non-compliant product to the Seller who will take it back and reimburse it.

The complaint regarding the non-conformity of the product must be sent to the Seller via the contact form on the site within a maximum period of 14 days from the date of receipt of the product. After this period, no returns or exchanges will be possible for the Buyer.

In the event of an error in the delivery and receipt of products intended for another customer, the Buyer is requested to keep the package(s) as is and to inform the Seller without delay via the contact form on the site.

9. Warranty

The Products sold on the Website comply with the regulations in force in France. The Products benefit automatically and in accordance with the legal provisions from the legal guarantee of conformity according to article L. 217 of the Consumer Code and from the legal guarantee against hidden defects in accordance with articles 1641 to 1649 of the Civil Code, at the condition that the buyer proves the hidden defect and acts within two years from the discovery of the defect (article 1648 of the Civil Code).

10. Right of withdrawal

The right of withdrawal does not apply to contracts relating to the supply of the following Products:

(ii) fresh and perishable products

(iii) goods unsealed by the Buyer after delivery and which cannot be returned for reasons of hygiene or health protection

Standard products

In accordance with the provisions of article L121-21 of the Consumer Code, the Buyer has a period of 14 days from the date of receipt of the standard products to exercise his right of withdrawal, without having to justify his decision. nor to bear any costs other than the costs of returning the products. The Buyer who wishes to withdraw must complete a withdrawal form available on the Seller's website in the “My account” section, then he must return the products to the Seller at his own expense within 14 days following communication of his decision. to retract.

Customized products

In accordance with the provisions of article L121-21-8 of the Consumer Code, the Buyer does not have the possibility of withdrawing after his order, to the extent that the products ordered and delivered are manufactured according to the specifications of the 'Buyer or clearly personalized. Consequently, products personalized according to the Buyer's specifications will not be returned or exchanged.

11. Returns and Exchanges

The costs of returning standard products returned in exercise of the right of withdrawal remain the responsibility of the Buyer. The Seller only takes responsibility for the return of non-compliant products or products from another customer delivered in error to the Buyer. Instructions for returning these products will be communicated to the Buyer by the Seller as soon as possible after receipt of the Buyer's complaint. In all cases of returns, the Buyer must return the products to the Seller in perfect condition in their entirety and in their original packaging.

13. Intellectual property

All texts, illustrations, graphics, images and products presented on the site are the exclusive property of the company PANACEA SAS. No reproduction is authorized without the prior consent of PANACEA SAS.

14. Liability

These general conditions of sale are subject to French law. The Seller cannot be held responsible for non-execution of the order in the event of force majeure, foreign causes or in the event of fault of the Buyer.
